The Factory License process generally varies by state, but in India the broad procedure is:

  1. Check applicability
    • A factory license is generally required if the manufacturing unit employs 10 or more workers with power or 20 or more workers without power and carries out a manufacturing process.
  2. Get factory plan approval
    • Submit the factory building/layout plan to the Department of Factories or Labour Department for approval before starting operations or construction/expansion.
  3. Prepare required documents
    Common documents include:
    • Factory layout and machinery layout
    • Ownership proof/lease agreement
    • Identity and address proof of occupier/manager
    • Details of manufacturing process
    • Fire safety approval/NOC (if applicable)
    • Pollution Control Board consent
    • Structural stability certificate
    • Details of workers and installed machinery/power load.
  4. Submit application
    • Apply through the state Labour/Factories Department portal or designated authority.
    • Provide details such as factory address, manufacturing activity, machinery, workforce, occupier, and manager.
  5. Pay prescribed fees
    • Fees are generally based on factors such as number of workers, power installed, and factory size.
  6. Inspection
    • The Factory Inspector may inspect the premises to verify compliance with safety, health, welfare, and operational requirements.
  7. License issuance
    • After successful verification and approval, the Factory License is issued, allowing manufacturing operations to commence legally.
